TERMS OF SERVICE
Terms of Service
Effective date: August 1, 2026
These Terms of Service ("Terms") govern your access to and use of the BDW Accounting & Consulting LLC website, client portal, contact forms, document-upload features, and related online services. By using the website or portal, you agree to these Terms.
About These Terms
"BDW," "we," "our," and "us" refer to BDW Accounting & Consulting LLC. "You" refers to the person or organization accessing the website or portal.
Additional engagement letters, service agreements, authorizations, or disclosures may apply to professional services and will control if they conflict with these website Terms.
Website Purpose and General Information
The website provides information about bookkeeping, business formation, tax preparation, real estate, certified mobile notary, certified loan signing agent, consulting, and related support. It may also allow you to contact us, request an appointment, access a client portal, and exchange documents.
Website content is general information only. It is not individualized tax, accounting, legal, investment, real estate, or financial advice.
No Professional Relationship Solely From Website Use
Visiting the website, submitting a form, sending a message, creating a portal account, or uploading a document does not by itself create a professional relationship. A relationship begins only when BDW expressly accepts an engagement and any required engagement letter, service agreement, payment arrangement, authorization, or identification process is completed.
Public Contact Form
The public contact form is for general inquiries only. Do not use it or ordinary email to transmit sensitive financial, tax, identity, or account information. Clients must use the Secure Client Portal at https://portal.bdw-companies.com for confidential document exchange. Submission of a public inquiry does not guarantee acceptance, availability, or a response within a specific period.
Client Portal Accounts
Authorized users may receive portal access for document exchange, service coordination, and related communications. You agree to provide accurate information and keep it current.
- Keep usernames, passwords, and authentication methods confidential.
- Use a strong, unique password and do not share access with unauthorized persons.
- Sign out after using a public or shared device.
- Promptly notify BDW of suspected unauthorized access or lost credentials.
BDW may require identity verification or other security measures and may restrict access when reasonably necessary to protect users, information, or systems.
Documents and Information You Provide
You represent that information and documents you provide are accurate and complete to the best of your knowledge, that you are authorized to provide them, that they do not violate applicable law or another person's rights, and that you will not knowingly upload malware or harmful code.
You remain responsible for reviewing documents and deliverables, correcting errors, answering questions, and providing requested information by applicable deadlines. Incomplete, inaccurate, late, or missing information may delay services or affect results.
Electronic Communications and Delivery
By providing contact information or using the portal, you consent to receive electronic communications related to inquiries, appointments, accounts, document requests, service updates, security, and transactions. You are responsible for keeping contact information current and reviewing notices.
Acceptable Use
- Do not attempt unauthorized access to accounts, servers, networks, or restricted areas.
- Do not interfere with website or portal operation, security, or availability.
- Do not upload malicious software, unlawful content, or infringing materials.
- Do not impersonate another person or misrepresent your authority.
- Do not probe, scrape, reverse engineer, or circumvent security controls except where permitted by law.
Notary and Loan-Signing Services
Notary and loan-signing services may require satisfactory identification, personal appearance, document completeness, willingness and awareness, payment, and compliance with applicable law. A notary does not provide legal advice or choose documents for you unless separately authorized and legally permitted.
BDW may decline or stop a notarial act when legal requirements are not met, identity cannot be verified, fraud or coercion is suspected, or the requested act is otherwise improper.
Intellectual Property
Website text, graphics, logos, design, layout, photographs, videos, downloads, and other content are owned by or licensed to BDW and protected by applicable law. You may not reproduce, publish, sell, modify, or distribute website content without prior written permission except as permitted by law.
Third-Party Services and Links
The website or portal may rely on or link to third-party providers. BDW does not control every third-party service and is not responsible for third-party content, availability, terms, or privacy practices.
Availability, Maintenance, and Changes
We may modify, suspend, restrict, or discontinue any website or portal feature. Access may be interrupted for maintenance, upgrades, security, provider outages, internet failures, or circumstances outside our reasonable control.
Disclaimer of Warranties
To the fullest extent permitted by law, the website, portal, and online content are provided "as is" and "as available." BDW disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, and freedom from harmful components except where a warranty cannot legally be disclaimed.
Limitation of Liability
To the fullest extent permitted by law, BDW and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of or inability to use the website or portal. Responsibilities relating to paid professional services are governed primarily by the applicable engagement letter or service agreement.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless BDW and its owners, employees, and contractors from third-party claims and reasonable expenses arising from your unlawful misuse of the website or portal, violation of these Terms, or documents submitted without authorization.
Suspension and Termination
BDW may suspend, restrict, or terminate access because of suspected fraud, unauthorized access, security risk, unlawful use, violation of these Terms, termination of a client engagement, or discontinuation of the portal.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to any controlling agreement or applicable law, disputes relating specifically to these Terms or website use shall be brought in a court of competent jurisdiction in Texas.
Severability and No Waiver
If any provision is found unenforceable, the remaining provisions continue to effect. Failure to enforce a provision is not a waiver of the right to enforce it later.
Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date.
